General terms and conditions for the accommodation contract

1. Scope
These general terms and conditions apply to contracts for the rental of camping pitches and holiday apartments, accommodation and all other services and deliveries provided to the customer by the operator and regulate the mutual rights and obligations between the guest and the operator._cc781905-5cde-3194-bb3b -136bad5cf58d_

By registering or booking, the guest agrees to the terms and conditions, the valid price list and the site regulations and thus also assumes liability for accompanying persons or visiting persons. 

The subletting or re-letting of the provided parking spaces or holiday apartments and their use for purposes other than accommodation are not permitted. 

The stay of young people under the age of 18 is only permitted if accompanied by a legal guardian or with a muddi slip.

The instructions of the staff regarding the installation of caravans, mobile homes and motor vehicles must be followed.

2. Booking / arrival and departure
Bookings can be made via email or via our website. For the conclusion of the contract, a payment-obligatory booking of the guest is required. The contract becomes effective with the written confirmation by the operator for the specified period and the registered persons.

Booking conditions for campsites:

Payment must be made in full upon receipt of the booking confirmation. The arrival and departure dates stated in the booking confirmation are binding. The booked parking space is available on the day of arrival at the times specified on our website or at individually agreed times. For pitches that are not occupied on the day of arrival, the pitch booking expires. A claim for damages remains reserved for this case and parking spaces that become free early. The pitch must be vacated by 11 a.m. on the day of departure at the latest. 

Rental Terms and Conditions: 

For 1 or 2 nights a surcharge will be charged.

Payment must be made in full upon receipt of the booking confirmation. For holiday apartments that are not occupied on the day of arrival, the booking expires. A claim for damages remains reserved in this case and if the holiday apartment is vacated prematurely.

The apartments are available on the day of arrival by appointment and must be vacated by 10 a.m. on the day of departure. 

The following cleaning work must be done by the guest: 

• strip beds

• Empty the fridge and trash can

• Dispose of rubbish and leave it swept clean. 

Smoking is not allowed in the rental accommodation. Pets are allowed with prior notification and confirmation from the operators. 

3. Obligations

The guest is generally obliged to good behavior, compliance with cleanliness, compliance with quiet times and the avoidance of noise that disturbs the peace.

It is the guest's responsibility to draw the operator's attention to defects and defects in the inventory before using the parking space or the holiday apartment.

4. Payment

The current price list applies.

Payments can be made via PayPal to info@zumwildenmichel.de or by advance transfer

5. Liability

The operator is not liable for damage caused by the failure or disruption of water or power supplies, for noise pollution by third parties or for negligent breaches of duty that result in damage caused by the use of the facilities, equipment and devices on the site . Likewise, there is no liability for damage, accidents, losses or other irregularities that arise in connection with the use of the holiday apartments, the campsite and the common areas. In the event of defects, the guest is obliged to notify the operator immediately in writing. If this notification is omitted, the guest is not entitled to any claims, regardless of the legal reason. Each guest assumes liability for the use of the playground. 

Insofar as liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the operator. Influence by force majeure excludes liability. 

6. Changes and Cancellations

Rebookings or contract changes are possible by arrangement. The operator reserves the right to charge a processing fee for this.

Cancellations by the guest:

Pitches - in case of cancellation from 30 days before arrival 70% of the payment made will be refunded, from 10 days before arrival 50% of the payment made will be refunded and from 3 days before arrival or no-show the payment will be retained. The cancellation must be made in writing in any case. In the event of early departure, the remaining days booked will be retained. 

Holiday apartments - if canceled less than 30 days before arrival, 50% of the payment made will be refunded, from 14 days before arrival or no-show the payment will be retained. The cancellation must be made in writing in any case. In the event of early departure, the remaining days booked will be retained. 

Cancellations by the operator:

The operator is entitled to extraordinarily terminate the guest without notice if the guest endangers others through his behavior, disturbs others, uses the rental property in breach of contract or otherwise behaves in breach of contract.

The verbal request to clear the space on the part of the operator and his staff is sufficient for the immediate termination of the contract. In this case, the guest is not entitled to a refund of the rent. 

7. Cancellation due to force majeure (camping and events) 

In cases of force majeure, such as in particular fire damage, lawful lockouts and epidemics (including epidemics and pandemics) insofar as a risk level of at least "moderate" has been defined by the Robert Koch Institute, the contractual party affected by this is for the duration and to the extent of the impact exempt from the obligation.

It is possible to arrange an alternative date.

Any costs already incurred must be paid.

8. Jurisdiction: 

German law applies exclusively between the guest and the operator. Place of performance and payment as well as exclusive place of jurisdiction is the seat of the operator Urste & kó GmbH.
